DEA Rules Delta-9-THCO and Delta-8-THCO Are Not Hemp

Last week, the Drug Enforcement Administration (DEA) issued a letter clarifying its stance on delta-9-THCO and delta-8-THCO. The letter states that while hemp is defined as containing 0.3% or less of delta 9 THC, hemp does not include synthetics such as delta 9 or delta 8 THC. As such, these synthetics are considered controlled substances under the Controlled Substances Act.

The DEA's ruling could also have implications for businesses selling products containing these synthetics. Companies that sell products containing Delta 9 or Delta 8 THC may now have to reevaluate their policies in order to ensure compliance with state and federal laws. Additionally, companies may need to take steps to ensure that their products do not contain any detectable levels of these synthetics in order to avoid potential legal issues down the road.
